Can a warrant of further detention be obtained for any offence?
Answer:
A warrant of further detention can be obtained for any indictable offence (as per section 43(4)(b) of PACE).
This means that such a warrant is available in relation to some offences that are not very serious, such as simple criminal damage, which is an either way offence (see Legal Q&A: Criminal damage - attempt). However, in less serious cases, it is likely that the courts will consider any applications for such a warrant very carefully.
