Legal Update - 26 November 2025


The Extradition Act 2003 (Designation of Part 2 Territories) Order 2003 is amended from 26 November 2025 (made by the Secretary of State under sections 69, 71(4), 73(5), 74(11)(b), 84(7) and 86(7) of the Extradition Act 2003):

  • The Hong Kong Special Administrative Region, and Zimbabwe, have been removed from article 2(2) of the Order. This means that they are no longer designated Part 2 territories. Cooperation can instead take place under section 194 (special extradition arrangements) of the 2003 Act on a case-by-case basis.
  • Chile has been added to article 3(2) of the Order, designating it as a Part 2, category A territory. This enables the UK to process extradition requests from Chile in accordance with the provisions of the 1957 Convention. Consequently, Chile has also been removed from article 4(2) to reflect that the applicable time frame for providing a request for extradition and required documents following provisional arrest is now governed by the 1957 Convention.
