Legal Update - 4 December 2025


The Property (Digital Assets etc.) Act 2025, which came into force on 2 December 2025, confirms a thing (including digital or electronic things) can be the subject of personal property rights, even where not a traditional thing in possession or thing in action. It is expected that things will include digital assets such as crypto tokens. However, the Act does not limit its scope only to electronic or digital things, nor does it provide a definition of a thing.

This will allow the courts to adopt a flexible approach, but it is likely that implications for Criminal Law will include things such as crypto being treated as property under the Theft Act 1968 and other related statutes.
