Legal Update - 2 February 2026
Further provisions of the Border Security, Asylum and Immigration Act 2025 are in force from 2 February 2026. The provisions commenced include but are not limited to the following:

Section 17 creates two new criminal offences prohibiting the creation (BS25006) or publication (BS25007) of material promoting unlawful immigration services online, including on social media platforms.

Section 18 establishes protection from liability for internet service providers relating to the section 17 offences.

Section 19 establishes the liabilities of relevant persons if online material promoting unlawful immigration services is created or published by a body corporate, a partnership or an unincorporated association other than a partnership.

Section 72 of the Nationality, Immigration and Asylum Act 2002 is also amended to define a sexual offence under Schedule 3 of the Sexual Offences Act 2003 as a ‘particularly serious crime’ for the purposes of excluding refugees from the protection from refoulement.
