New alcohol abstinence and monitoring provisions

19 May 2020

New section 212A of the Criminal Justice Act 2003 is in force from 19th May 2020, providing new alcohol abstinence and monitoring powers. Criminals who commit alcohol-fuelled crime may be banned from drinking and made to wear 'sobriety tags' / ankle tags. Drinking could see offenders returned to court for further sanctions.

The ankle tags, which are to be rolled out across England and Wales, perform around-the-clock monitoring of an offender’s sweat to determine whether alcohol has been consumed.

This follows two successful pilot schemes; a national rollout will commence later this year.
