Amended: Health Protection (Coronavirus, Restrictions) (All Tiers) (England) Regulations 2020

The Health Protection (Coronavirus, Restrictions) (All Tiers) (England) Regulations 2020 provide the restrictions that apply to each Tier within England, for example, in relation to travel, gatherings and businesses.

These Regulations have been amended from 6 January 2021, to strengthen the Tier 4 restrictions and move every area in England into that Tier.

The exemptions to the restrictions on leaving home, in Schedule 3A, Part 1, have been amended as follows:

The exceptions in relation to visiting a public outdoor place for the purposes of open air recreation and visiting outdoor attractions such as zoos and safari parks, have been removed; this is no longer allowed in Tier 4. Exercise is still permitted outside in a public outdoor place.

Outdoor sports grounds and sports facilities have been removed from the definition of a public outdoor place, so people are no longer able to use these facilities when taking exercise outside (Exception 1 – paragraph 2(2) of Schedule 3A).

The exception in relation to children (Exception 9 – paragraph 2(13) of Schedule 3A) has been amended, so that later years childcare (5 years and older) is only permitted for the children of critical workers.

The exception in relation to attending a parent and child group has been removed.

The reference to persons aged under 18 has been removed from the exception in relation to permitted outdoor sports gatherings (Exception 14 – paragraph 2(19) of Schedule 3A), so this now only applies to persons how have a disability.

The exemptions to the restrictions on gatherings, in Schedule 3A, Part 2, have been amended as follows:

Gatherings are no longer permitted at outdoor sportsgrounds or sports facilities; (paragraph 4 of Schedule 3A) – previously two people were allowed to meet at these places.

The exception in relation to children (Exception 13 – paragraph 6(19) of Schedule 3A) has been amended, so that later years childcare (5 years and older) is only permitted for the children of critical workers.

The exception in relation to attending a parent and child group has been removed.

The restrictions on businesses, in Schedule 3A, Part 3, have been amended as follows:

The sale of alcohol as part of a takeaway service for consumption off premises is not permitted. The sale of alcohol is only allowed in response to orders received online, by phone or by post and must be delivered – it cannot be collected as part of takeaway or click and collect and drive through.

The following businesses have been added to the list in Schedule 3A and must now close:

Outdoor gyms, sports grounds, sports facilities, fitness studios, dance studios, skating rinks and swimming pools (previously only indoor ones).

Shooting and archery venues, golf courses, and driving ranges.

Aquariums, zoos, safari parks, animal attractions at farms, wildlife centres and any other place where animals are exhibited to the public as an attraction.

Retail travel agents.

All areas of England have now been moved to Tier 4 (Schedule 4, Part 3).

These Regulations have also been extended, to expire on 31 March 2021, rather than 2 February 2021.
